Understanding the Federal Family and Medical Leave Act

The Family and Medical Leave Act, commonly referred to as the FMLA, helps employees during difficult family and medical situations. This Act entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons. During the leave period, group health insurance coverage must be continued under the same terms and conditions as if the employee had not taken leave. The Act also requires the employer to place an employee back into his or her previous position after returning from an FMLA-qualified leave. While aiding an employee with continued health care coverage, the FMLA can also provide the much needed peace of mind from knowing his or her job will be waiting upon return from leave.

Eligible employees are entitled to twelve workweeks of leave in a 12-month period, according to the FMLA. Situations covered can be:

  • The placement with the employee of a child for adoption or foster care and to care for the newly placed child within one year of placement;
  • The birth of a child and to care for the newborn child within one year of birth;
  • A serious health condition that makes the employee unable to perform the essential functions of his or her job;
  • To care for the employee’s spouse, child, or parent who has a serious health condition;
  • Any qualifying exigency arising out of the fact that the employee’s spouse, son, daughter, or parent is a covered military member on “covered active duty;”
