Satellite Installer Files Class Action Lawsuit

Today, we filed suit in federal court in San Antonio, Texas on behalf of Thomas Watt and a class of  satellite internet installers, claiming they were misclassified as independent contractors and are owed unpaid overtime under the Fair Labor Standards Act (FLSA).  The defendants in the case are two entities—Roga Satellite, Inc. and Zavalla Bam Tex, LLC—that do business as “Bam Techs” and are Hughes Net authorized retailers and three individuals—Michael Deemer, Christopher Springer, and Billy Linthicum.

Watt and the installers claim that they were actually the employees of the defendants and therefore were entitled to overtime compensation for their long hours of work.  The lawsuit cites the fact that defendants (1) required the Installers comply with numerous policies and procedures in an installer handbook; (2) prohibited the installers from working for any other HughesNet retailer; (3) dictated how the installers installed the satellite equipment, including the order of various steps of installation; (4) required that the installers purchase the installation materials from the defendants; (5) withheld assignments from the installers if they missed regular meetings; and (6) gave preferential treatment to installers who were available to work all day, six days a week.

Employers that violate the FLSA are subject to double damages for all of the wages they failed to pay their workers. Employers are also responsible for an employee’s attorneys’ fees and costs if the employee prevails.  In the lawsuit, Watt is seeking to represent a class of the defendants’ installers and is requesting lost wages, liquidated (double) damages, injunctive relief, attorneys’ fees, costs, and expenses.
