On Tuesday, August 8, 2017, Moreland Law Firm, P.C. filed suit in Federal Court in Houston, Texas against Divine Healers, Inc. (doing business as Healing Hands Healthcare) on behalf of Victor Garcia and a class of Divine Healers’ LVNs, RNs, CNAs, and Providers.
Garcia brings claims under the Fair Labor Standards Act (the “FLSA”) against Divine Healers, a Houston-based home health care company. The FLSA is the federal law that requires covered employers pay their employees overtime-time and a half for all hours worked over forty. Employers that violate the FLSA could be required to pay twice the amount of unpaid back wages to affected employees as well as their attorneys’ fees for bringing suit.
Garcia is a LVN and former employee of Divine Healers. In the lawsuit, Garcia claims he regularly worked more than forty hours in a week. But Garcia was not paid time and a half his regular rate of pay for any of those hours. Garcia is also requesting that the Court conditionally certify a class of other LVNs, RNs, CNAs, and Providers who also worked for Divine Healers but were also not properly paid overtime.
In the lawsuit, Garcia–on his behalf and behalf of the entire class–is requesting lost wages, liquidated (double) damages, injunctive relief, and attorneys’ fees.
