Moreland Law Firm files class action lawsuit on behalf of bartenders, bartenders, and servers paid tips only.

On Wednesday, August 23, 2017, Moreland Law Firm, P.C. filed suit in Federal Court in San Antonio, Texas against individuals and entities running two San Antonio medical center bars-4th Quarter Sports Bar and 8811 Patio Bar. The case was filed on behalf of Mario Sanchez and a class of bartenders, barbacks, and servers.

Sanchez brings claims under the Fair Labor Standards Act (the “FLSA”) against the bars and the individuals who own them. The FLSA is the federal law that requires covered employers pay their employees minimum wage and overtime. Employers that violate the FLSA are subject to double damages for all of the wages they deprived their workers. Employers are also responsible for the employee’s attorneys’ fees if the employee prevails.

Sanchez is a former bartender and barback at both 4th Quarter Sports Bar and 8811 Patio Bar. He claims that both bars, which are jointly managed, required that he and all other bartenders, barbacks, and servers work for tips only. Neither bar paid Sanchez minimum wage or time and a half for his overtime hours.

In the lawsuit, Sanchez-individually and behalf of bartenders, barbacks, and servers at 4th Quarter Sports Bar and 8811 Patio Bar-is requesting lost wages, liquidated (double) damages, injunctive relief, and attorneys’ fees.
