Manual Laborer Files Federal Class Action Lawsuit Alleging Masonite Shorts Overtime

On Thursday, January 11, 2018, Moreland Law Firm, P.C. filed suit in Federal Court in Dallas, Texas against Masonite Corporation. The case was filed on behalf of Desmond Mathis and a class of employees performing manual labor for Masonite.

Mathis brings claims under the Fair Labor Standards Act (the “FLSA”) against Masonite. The FLSA is the federal law that requires covered employers pay their employees the minimum wage and overtime. Employers that violate the FLSA are subject to double damages for all of the wages they deprived their workers. Employers are also responsible for the employee’s attorneys’ fees and costs if the employee prevails.

The lawsuit claims that Masonite shorted Mathis and other manual labor employees overtime not paying time-and-a-half for weeks where they worked more than forty hours. The lawsuit also claims that Masonite paid Mathis and other manual labor employees non-discretionary bonuses but failed to include those bonuses when determining the appropriate overtime rate.

In the lawsuit, Mathis seeks to represent a class of manual labor employees at Masonite and is requesting lost wages, liquidated (double) damages, injunctive relief, and attorneys’ fees.
