National Healthcare Corporation

Case Information:

This is a Fair Labor Standards Act (FLSA) case brought by a former registered nurse for National Healthcare Corporation and NHC Healthcare/Franklin, LLC.  The lawsuit claims that National Healthcare Corporation and NHC Healthcare/Franklin, LLC wrongfully failed to pay overtime to its hourly home health employees, including registered nurses and certified nursing assistants. We are requesting class certification and judicially supervised notice.

Employers that violate the FLSA are subject to double damages for all of the wages they failed to pay their workers. Employers are also responsible for an employee’s attorneys’ fees and costs if the employee prevails.  In the lawsuit, we are seeking to represent a class of hourly Registered Nurses and Certified Nursing Assistants and are requesting lost wages, liquidated (double) damages, injunctive relief, attorneys’ fees, costs, and expenses.
