Can a male employee sue for sexual harassment?

It used to be that women were the people primarily concerned with being a victim of sexual harassment, but it is becoming more common for men to be a victim of sexual harassment as well. Now more and more men are finding that they are able to file lawsuits for sexual harassment and put an end to the stress and pressure that this places on employees in the workplace.

US Equal Employment Opportunity Commission

The US Equal Opportunity Commission (EEOC) has established a standard to which all sexual harassment cases are evaluated. It has already been established by the EEOC that even if you are not the victim of the actual harassment, but are offended by the harassing remarks, and the harassing statements are objectively offensive, then you may be a victim of harassment as well.

There has been an increase in the number of men who have filed sexual harassment lawsuits. This could be because there are, in fact, more men being harassed in the workplace or because more men are becoming comfortable with talking about what is happening. Regardless of the cause, it is important to recognize unlawful workplace harassment in order to take steps to stop it.

Sexual harassment could include any of the following:

  • The sexual advances and propositions are unwelcome.
  • Feelings of threats to job or job security because of the advances.
  • Harassment does not have to come from a supervisor. It can come from a peer, employee, supervisor, non-employee or other employee from another division within the same or different company.
  • It can sometimes be difficult to recognize what constitutes harassment.
  • The harasser can be from the opposite sex or from the same sex.
